1. ACCEPTANCE OF TERMS
By downloading, installing, or using the 12345APP application ("Service", "App", "we", "us", or "our"), you ("User", "you", or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must immediately cease using the Service and uninstall the App.
AGE REQUIREMENT: You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are 18 years or older. We do not knowingly collect information from or direct any of our content specifically to children under 18.
2. SERVICE DESCRIPTION
The Service provides privacy protection and secure network access through encrypted tunnel technology and our global server infrastructure. Our core mission is to protect your online privacy. All user data is stored exclusively in Australia. Available on iOS (Apple App Store), Android (Google Play Store), Windows (Microsoft Store), and macOS (Mac App Store). Services include encrypted tunnel connections, multiple server locations worldwide for traffic routing (tunnel servers do not store user data), privacy-focused traffic management, account management, and customer support.
3. ACCOUNT REGISTRATION AND SECURITY
You must provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials. Each account is limited to a specified number of concurrent device connections. You must notify us immediately of any unauthorized access or security breach.
4. PAYMENT AND ACCESS PERIODS
Payment Processing: All payments are processed through Stripe as single purchases. We do not process payments through app stores. Your payment card details are forwarded to Stripe at frontend for processing and are NEVER stored on our servers. We only retain transaction records (amount, date, status) for accounting purposes.
Access Period Packages: We offer various time-based access packages (e.g., 30 days, 90 days, etc.). Each purchase is a one-time payment for a specific access period. Prices displayed in Australian dollars (AUD). Access periods do NOT automatically renew - you must purchase a new access period before expiration to continue using the service.
Account Access: You can access your account on any supported platform (iOS, Android, Windows, macOS) by logging in with your credentials.
5. REFUND POLICY
General Policy: Due to the nature of our service, all sales are final. When you purchase an access period package, our infrastructure costs (server resources, bandwidth, encrypted tunnel capacity) are incurred immediately upon activation. These operational costs cannot be recovered once service access has been provided.
Important Notice: Refunds are generally not available for digital services after activation. This includes but is not limited to: change of mind, failure to use the service, dissatisfaction with performance, account termination for policy violations, inability to access due to external factors (local network restrictions, government regulations, device compatibility), or user error.
Refund Requests: In exceptional circumstances and at our sole discretion, we may evaluate refund requests on a case-by-case basis. All refund decisions are final and non-appealable. To request consideration, contact [email protected] within 7 days of purchase with your order details.
Approved Refunds: If approved, refunds are partial only (calculated based on infrastructure costs already incurred and service usage). Refunds are NOT processed through Stripe. You must provide valid government-issued identification (passport or driver's license) and corresponding bank account information for identity verification. Refunds are processed exclusively via Wise international bank transfer. Processing takes 5-10 business days after identity verification and bank details are confirmed. Original Stripe payment processing fees are non-refundable and will be deducted from any approved refund amount.
Legal Compliance: This policy does not affect your statutory rights under mandatory consumer protection laws where applicable.
6. ACCEPTABLE USE POLICY
You agree NOT to use the Service for: any illegal activities, distributing malware, unauthorized access to systems (hacking), harassment or threats, distributing child exploitation material, spamming or phishing, copyright infringement, DDoS attacks, or any activity that violates the rights of others. Accounts found violating this policy will be immediately terminated without refund.
7. SERVICE AVAILABILITY
We strive to maintain high uptime but do not guarantee uninterrupted service. Server availability may vary by location. Brief service interruptions for maintenance, updates, or technical issues may occur. We reserve the right to modify, suspend, or discontinue any aspect of the Service with notice when possible. Service interruptions do not entitle users to refunds except as outlined in Section 5.
8. INTELLECTUAL PROPERTY
All Service content, features, and functionality are owned by us and protected by copyright and trademark laws. You receive a limited, non-exclusive, non-transferable license to use the Service. You may not copy, modify, distribute, or reverse engineer any part of the Service.
9. PRIVACY AND DATA PROTECTION
Your privacy is important to us. Our Privacy Policy explains what data we collect, how we use it, and your rights. We do NOT log browsing history, DNS queries, or traffic content. We only retain minimal connection metadata necessary for service operation.
10. LIMITATION OF LIABILITY
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.
11. INDEMNIFICATION
You agree to indemnify and hold harmless 12345APP from any claims, damages, losses, and expenses arising from your use or misuse of the Service, your violation of this Agreement, or your violation of any applicable laws.
12. TERMINATION
You may terminate your account at any time. Termination does not entitle you to any refund for unused access periods. We may suspend or terminate your account immediately, without notice or refund, for violation of this Agreement, fraudulent activity, abuse of resources, or legal requirements. All outstanding amounts remain due upon termination.
13. DISPUTE RESOLUTION
This Agreement is governed by applicable law. Disputes shall be resolved through binding arbitration on an individual basis. YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS-ACTION LAWSUITS OR CLASS-WIDE ARBITRATION.
14. AFFILIATE PROGRAM
We may offer an affiliate/referral program. Affiliates earn rewards on referred customer payments. Reward rates and terms are subject to change. We reserve the right to withhold rewards for fraudulent referrals.
Affiliate Rewards: Payouts are processed only via Wise. Minimum withdrawal thresholds apply.
Prohibited Activities: False advertising, trademark misuse, spam, cookie stuffing, and other fraudulent techniques.
15. ACCOUNT DELETION AND DATA RIGHTS
Account Deletion: You may request account deletion at any time by contacting [email protected]. Upon deletion, your account data will be permanently removed within 30 days, except where retention is required by law.
Data Access: You have the right to request a copy of your personal data. Contact [email protected] to exercise this right.
Data Portability: You can export your account data before deletion by requesting it through our support channels.
16. APP PERMISSIONS
App Permissions (iOS/Android/Windows/macOS): The app may request the following permissions:
- Network Access: Required to establish secure encrypted tunnel connections
- Tunnel Configuration: Required to route traffic through our servers
- Notifications: Optional, for service alerts and access period expiration reminders
- Storage: Minimal, for app preferences and configuration
All permissions are used solely for service functionality. We do not access personal files, contacts, location, camera, microphone, or other sensitive device data.
17. MODIFICATIONS
We reserve the right to modify these Terms at any time. Changes will be effective 30 days after notice for existing users (via email or in-app notification). Continued use after changes constitutes acceptance. Major changes will require re-acceptance in the app.

Location Data Disclosure: LOCATION data is accessed by the app but not disclosed in privacy policy. We do not collect or store your location. Location data is used solely on-device to create encrypted tunnels by selecting optimal servers based on your approximate region. This data never leaves your device and is not transmitted to our servers.
Data Sharing: We do NOT sell your data. We do NOT share your data with advertisers. Limited sharing only with payment processors (Stripe, Wise) and email service providers for essential account communications.
Security: Data encrypted in transit and at rest using industry-standard encryption (TLS 1.3, Ed25519).
Data Storage Location: All user data stored exclusively in Australia. Global encrypted tunnel servers do NOT store any user data.

5. DATA RETENTION
Active Accounts: Account data retained while active; transaction records retained for 7 years (tax and accounting requirements - amount, date, status only, no payment card details); connection metadata retained for 30 days maximum.
Closed Accounts: Most data deleted within 30 days; transaction records retained for legal requirements (7 years); backups deleted within 90 days.
6. DATA SECURITY
We use industry-standard encryption (TLS 1.3, Ed25519), role-based access controls, regular security audits, DDoS protection, and secure server configurations. However, no security system is 100% impenetrable. You are responsible for protecting your account credentials.
7. YOUR PRIVACY RIGHTS
All Users:
- Access: Request a copy of your personal data
- Correction: Update or correct inaccurate information
- Deletion: Request deletion of your account and data
- Portability: Receive your data in machine-readable format
- Objection: Object to certain data processing activities

9. CHILDREN'S PRIVACY
